These Terms of Service (“Terms”) govern your access to and use of AxiomaSoft’s cloud-based software solution Certikeeper for certificate management in relation to food safety (the “Service”). By accessing or using our Service, you agree to these Terms. If you do not agree with these Terms, you must not use the Service.
By registering for, accessing, or using the Service, you confirm that you are at least 18 years of age, or, if using the Service on behalf of an organization, that you have the authority to bind that organization to these Terms.
Our Service provides cloud-based solutions for managing certificates related to food safety. The Service allows users to store, manage, and track food safety certificates, ensuring compliance with regulatory standards and legislation. The Service includes additional features such as document storage, automated alerts, and reporting tools.
To access and use certain features of the Service, you must have an account. You agree to provide accurate, complete, and up-to-date information for your account, and you are responsible for maintaining the confidentiality of your login credentials. You are responsible for any activities that occur under your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including those related to food safety and certification.
You may not use the Service:
We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable for any unavailability of the Service, whether due to scheduled maintenance or unexpected outages.
Certain features of the Service require payment of fees. By using those features, you agree to pay all applicable fees as described at the time of your purchase or subscription. Fees are non-refundable unless otherwise stated. We reserve the right to change our pricing at any time.
All intellectual property rights in the Service, including but not limited to software, trademarks, logos, and content, are owned by or licensed to AxiomaSoft B.V.. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for managing food safety certificates within your organization.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
We are committed to protecting your privacy. Our use of your personal data is governed by our Privacy Policy, which outlines how we collect, use, and protect your information.
You are responsible for maintaining the confidentiality of your account credentials and any data you upload to the Service. You agree to notify us immediately if you become aware of any unauthorized access to your account.
Our Service may integrate with or provide access to third-party services. These services are subject to their own terms and privacy policies. We are not responsible for the content, accuracy, or availability of third-party services, and your use of those services is at your own risk.
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including, without limitation, any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, secure, or free from viruses or harmful components.
To the maximum extent permitted by law, AxiomaSoft B.V. will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or in connection with your use or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability under these Terms, for any reason and upon any cause of action, is limited to the amount you paid to us for use of the Service in the 12 months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless AxiomaSoft B.V., its affiliates, and its respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to suspend or terminate your access to the Service at our sole discretion if you breach these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease, and any data you have stored in the Service may be deleted.
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms will be resolved exclusively in the courts located in the Netherlands.
We may update these Terms from time to time. Any changes will be effective when posted on this page, and we will indicate the date of the last revision. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
